These Terms and Conditions (“Terms”) govern your use of the website, online services, parent communications, text messaging program, and other electronic services provided by Kids of Harmony Preschool, LLC (“Kids of Harmony,” “we,” “us,” or “our”).
By accessing our website, submitting information through an online form, creating or using a parent account, or participating in our communication services, you agree to these Terms.
These Terms primarily govern the website and electronic communication services. The current Parent Handbook, enrollment application, tuition agreement, health forms, consent forms, and other signed or published preschool documents govern enrollment, attendance, tuition, health and safety, discipline, pickup procedures, classroom operations, and other aspects of preschool participation.
If these Terms conflict with a signed enrollment document or the current Parent Handbook concerning preschool enrollment or operations, the applicable enrollment document or Parent Handbook will control. These Terms do not replace or modify any responsibility that Kids of Harmony has under applicable childcare laws, licensing requirements, or written enrollment agreements.
1. About Kids of Harmony Preschool
Kids of Harmony Preschool, LLC provides preschool, childcare, educational, and related services to children and families. Information provided through our website is intended to help parents and guardians learn about our programs, communicate with us, and access services related to enrollment and participation.
The availability, schedules, fees, eligibility requirements, classroom assignments, operating hours, and features of our programs may change. Enrollment is subject to availability, completion of required documentation, payment arrangements, and compliance with applicable preschool policies.
2. Use of Our Website and Services
You agree to use our website and services only for lawful purposes and in a manner consistent with these Terms.
You may not:
- Use the website or services for fraudulent, unlawful, abusive, or harmful purposes
- Attempt to gain unauthorized access to an account, system, database, or network
- Interfere with the security, availability, or operation of the website or services
- Upload or transmit viruses, malicious code, or other harmful material
- Impersonate another person or misrepresent your identity or authority
- Submit false, misleading, incomplete, or unauthorized information

Parents and guardians are responsible for ensuring that they have the authority to provide information concerning a child and any listed emergency contact, authorized pickup person, or other individual.
4. Parent and Guardian Responsibilities
Parents and guardians are responsible for reviewing and following applicable enrollment agreements, parent handbooks, health and safety policies, pickup procedures, payment requirements, and other preschool rules.
Website content and electronic communications do not replace direct communication with preschool staff when a matter involves a child’s immediate health, safety, supervision, custody, or medical needs.
In an emergency, call 911 or the appropriate emergency service. Do not rely on website forms, email, text messaging, or parent-portal messages for urgent or life-threatening emergencies.
5. Accounts and Account Security
Certain services may require a parent or guardian account. You are responsible for:
- Maintaining the confidentiality of your username, password, and access credentials
- Restricting access to devices used to access your account
- All activity occurring through your account
- Promptly notifying us of suspected unauthorized access or misuse
You may not share account credentials with an unauthorized person. We may require identity verification before changing account information, releasing records, or providing access to sensitive information.
6. Electronic Communications
No single electronic communication method is guaranteed. Parents and guardians remain responsible for reviewing the communication methods designated by Kids of Harmony, which may include the parent communication system, email, telephone, website or calendar notices, newsletters, and written notices sent home.

7. Text Messaging Program Terms
Program Description
Kids of Harmony offers an optional text messaging program for parents, guardians, emergency contacts, authorized adults, prospective families, and other persons who have agreed to receive messages.
Messages may include:
- Weather delays and closures
- Emergency and safety announcements
- Schedule changes
- Event and activity reminders
- Enrollment and registration communications
- Attendance, pickup, or account-related notices
- General preschool and classroom announcements
Consent to Receive Text Messages
By affirmatively opting in, you authorize Kids of Harmony Preschool, LLC and its service providers to send recurring text messages to the mobile telephone number you provide. Messages may be sent using automated technology.
Consent to receive text messages is voluntary and is not a condition of enrollment or purchasing preschool services.
You represent that you are the subscriber or customary user of the mobile number provided and that you are authorized to consent to receive text messages at that number. You agree to notify us promptly if the number is reassigned, disconnected, or no longer used by you.
Message Frequency
Message frequency varies depending on school schedules, events, emergencies, account activity, weather conditions, and other preschool operations. You may receive multiple messages during periods involving emergencies, closures, schedule changes, or time-sensitive announcements.
Message and Data Rates
Message and data rates may apply. Your mobile carrier’s rates, terms, and conditions govern charges associated with receiving or sending text messages.
How to Opt Out
You may cancel text messages at any time by replying STOP to a message from Kids of Harmony.
After submitting an opt-out request, you may receive one final message confirming that you have been unsubscribed. After that confirmation, we will not send additional messages through that text messaging program unless you provide renewed consent or otherwise request that messages resume.
We will also honor other clear and reasonable requests to stop text messages. You may contact us directly using the information in the “Contact Us” section below.
Opting out of text messages does not prevent Kids of Harmony from contacting you through other available methods, including telephone calls, email, postal mail, parent-portal messages, or in-person communication.

Supported Carriers and Delivery
Text message delivery depends on your mobile device, wireless carrier, network availability, and other factors beyond our control. Not all devices, carriers, or service plans may support every feature.
Wireless carriers are not liable for delayed or undelivered messages. Kids of Harmony does not guarantee that any text message will be delivered, received, or read within a particular time.
Text messaging should not be relied upon as the sole means of receiving emergency, closure, health, safety, or time-sensitive information. Parents and guardians should also monitor other communication methods made available by the preschool.
Privacy
Information collected and processed through our text messaging program is governed by our Privacy Policy.
Mobile information, text-message opt-in data, and consent records will not be shared with third parties or affiliates for their own marketing or promotional purposes. Information may be provided to service providers acting on our behalf as necessary to operate and deliver the messaging program.
8. Fees, Tuition, Billing, and Payments
Tuition, enrollment fees, deposits, before-care charges, after-care charges, late-pickup fees, returned-payment fees, lunch charges, and other amounts are governed by the current Parent Handbook, enrollment application, published fee schedule, and any applicable written agreement.
Preschool tuition is an annual charge for reserving a student’s place for the school year. Payment options may divide that annual charge into installments, but tuition is not calculated according to the number of days the student attends.
Except as otherwise stated in writing by Kids of Harmony:
- Tuition will not be reduced, credited, or refunded because of absences, illness, vacations, holidays, weather closures, or other missed days.
- Payments must be made according to the payment plan selected in the enrollment application.
- A payment received after its due date may be subject to the late fee stated in the current Parent Handbook or fee schedule.
- A student may be prevented from attending while required tuition or fees remain unpaid.
- Returned payments may be subject to a returned-payment fee and restrictions on future payment methods.
- Withdrawal obligations, including notice requirements and tuition due following withdrawal, are governed by the current Parent Handbook and enrollment documents.
Online payments may be processed by a third-party payment provider. Use of that payment service may also be subject to the provider’s terms and privacy policy.
9. Website Information Is General in Nature
We attempt to keep website information accurate and current, but we do not guarantee that all content is complete, error-free, or current at all times.
Website information does not replace official enrollment agreements, parent handbooks, licensing requirements, written notices, or direct instructions from authorized preschool personnel. If website information conflicts with a signed agreement or formal preschool policy, the applicable agreement or policy will control.
10. Health and Medical Information
Website content and electronic communications are not medical advice and should not be used to diagnose or treat a medical condition.
Parents and guardians are responsible for providing complete and current information about a child’s health, allergies, medications, dietary restrictions, disabilities, accommodations, and emergency needs through the preschool’s designated procedures.
Do not submit highly sensitive or urgent medical information through an unsecured website form, ordinary email, or text message unless specifically instructed to do so.
11. Photographs, Videos, and Media
Any use of a child’s photograph, video, voice, artwork, or identifying information will be subject to applicable parental authorizations, enrollment documents, preschool policies, and legal requirements.
Nothing in these Terms independently grants Kids of Harmony permission to use a child’s likeness for public advertising or promotional purposes when separate parental authorization is required.
12. Intellectual Property
Unless otherwise stated, website text, graphics, logos, designs, photographs, documents, downloadable materials, and other content are owned by or licensed to Kids of Harmony and are protected by applicable intellectual-property laws.
You may view, download, or print website materials for personal, noncommercial use related to evaluating or participating in our programs. You may not reproduce, distribute, modify, publicly display, sell, license, or commercially exploit our content without prior written permission.
13. Third-Party Services and Links
Our website and communications may include links to third-party websites, payment processors, parent portals, maps, social media platforms, or other external services.
Kids of Harmony does not control and is not responsible for the content, availability, security, privacy practices, or terms of third-party services. Accessing a third-party service is at your discretion and may be subject to separate terms and policies.
14. Availability and Changes to Services
We may modify, suspend, restrict, or discontinue all or part of our website or online services when reasonably necessary for maintenance, security, operational, legal, or business reasons.
We do not guarantee uninterrupted or error-free access to the website, parent portal, text messaging, email, or other electronic services.
15. Disclaimer of Warranties
To the extent permitted by law, our website and electronic services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
We do not warrant that the website or electronic services will always be available, secure, accurate, complete, uninterrupted, or free from errors, viruses, or other harmful components.
Nothing in this section limits obligations that cannot lawfully be excluded or modified, including obligations relating to the care and supervision of enrolled children.
16. Limitation of Liability
To the extent permitted by applicable law, Kids of Harmony Preschool, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from the use of or inability to use our website or optional electronic communication services.
This limitation does not apply where liability cannot lawfully be limited and does not modify any responsibility established by an enrollment agreement, childcare law, licensing requirement, or other applicable legal obligation.
17. Indemnification
To the extent permitted by law, you are responsible for losses caused by your intentional unlawful use of the website, unauthorized access to another person’s account, introduction of malicious software, or knowing infringement of another person’s rights.
This provision does not require a parent or guardian to indemnify Kids of Harmony for Kids of Harmony’s own negligence, misconduct, or violation of law.
18. Privacy Policy
Our collection, use, protection, and disclosure of personal information are described in our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
19. Questions, Complaints, and Grievances
Parents and caregivers are encouraged to raise questions or grievances directly and confidentially with the Director. Kids of Harmony will attempt to address the matter at the earliest reasonable opportunity.
If the matter is not resolved, the parent or caregiver may submit the grievance in writing to the Preschool Governing Board. If the matter remains unresolved after the internal process, the parent or caregiver may contact the applicable state childcare licensing representative.
Nothing in this section prevents a person from contacting an appropriate government agency or seeking other rights or remedies available under law.
20. Governing Law
These Terms are governed by the laws of the State of West Virginia, without regard to conflict-of-law principles, except where federal law applies.
Any legal proceeding concerning these Terms will be brought in a court of competent jurisdiction serving the county in which Kids of Harmony Preschool, LLC has its principal place of business, unless applicable law requires otherwise.
21. Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
22. No Waiver
A failure by Kids of Harmony to enforce a provision of these Terms does not waive the right to enforce that provision or another provision later.
23. Changes to These Terms
We may update these Terms periodically to reflect changes in our services, technology, policies, or legal obligations. The revised version will be posted on this page with an updated “Last Updated” date.
When appropriate, material changes may also be communicated through email, text message, a parent portal, website notice, postal mail, or another reasonable method.
